2017 OVATION AWARD Winners Announced

The Marriott Vancouver was the place to be, and be seen, on Saturday night as the star-studded 2017 Ovation Awards Gala, presented by FortisBC (who graciously gave away a $1,000 natural gas BBQ to the winning answer), played out to an evening of cool live jazz, champagne cocktails (compliments of Floform Countertops and Cambria), and sumptuous food. Entertaining emcee, Bianca Solterbeck of Shaw notoriety, kept us all on the edge of our seats with exciting winning Ovation announcements. Guests were treated to parting gifts by PPG Canada/Dulux as they headed off to the ever-popular O-Lounge after-party, sponsored by Graytek and Caesarstone Canada, which from all accounts the celebrations continued into the early hours of Sunday morning.

BC Construction Industry Raising $1 Million for Wildfire Relief: #Here4BC

BC CONSTRUCTION INDUSTRY RAISING $1 MILLION FOR WILDFIRE RELIEF: #HERE4BC
The BC and Canadian construction industry comes together to support those affected by the BC wildfires



VANCOUVER, B.C. – Support for the Here4BC campaign, launched on July 18 by the Vancouver Regional Construction Association (VRCA), has gained huge momentum across the Canadian construction industry, with 56 companies and associations, including the Greater Vancouver Home Builders’ Association (GVHBA) and the Urban Development Institute (UDI), committing to raise $1 million dollars to assist British Columbians who have been displaced, lost homes and businesses, and much more as a result of the wildfires.

The Here4BC program encourages the industry to contribute to the Red Cross British Columbia Fire Appeal, through financial donations and/or by contributing to the online registry of supplies, services and equipment that can be loaned or donated to the relief efforts. “We’re incredibly proud to see the industry joining resources to help British Columbians in need,” says VRCA President, Fiona Famulak. “The key to this campaign’s success is having Associations in the Canadian construction industry mobilize their members, especially those in B.C. So far, more than $124,000 has been raised – and is increasing by the hour -- with BC donors contributing 77% of those funds.”

Bob de Wit, GVHBA CEO, says the wildfire devastation really hits home for members. “Our members’ passion is in building homes and neighbourhoods for families, so seeing the incredible losses experienced by these communities has spurred many members to ask us, ‘How can we help?’ We’re proud to be part of this important initiative,” says de Wit.

“The wildfire situation doesn’t just impact the people living in those communities,” says UDI President & CEO Anne McMullin, “it touches all British Columbians so it is important that we all work together to help those in this time of need.”

The online Here4BC fundraising campaign will run until August 31. Help amplify the call for donations. The website, www.Here4BC.ca, contains information on how companies, their employees and associations can help, as well as direct links to donate to the Canadian Red Cross British Columbia Fires Appeal. Everyone is encouraged to share via social media, using the hashtag #Here4BC.

When a “Small” Job Isn’t So Small After All

It is not uncommon that a project initially expected to be a “small” job becomes more complicated as work proceeds. This can often become a point of contention with clients, regardless of whether you have a written or oral contract. In the recent Provincial Court case of Portnoy and Khait v. Pacific West Mechanical, a plumbing service took a small financial hit, when a “small” job became more complex than originally planned. 
 
THE FACTS
 
This case involved a couple (the “Homeowners”) that owned a condo unit in Vancouver. The Defendant was a plumbing contractor retained to perform plumbing kitchen repairs at the Homeowners’ condo unit.  The Defendant estimated one-hour to complete these repairs.
 
However, the repairs took longer than expected because the Homeowners had recently replaced their kitchen sink, which resulted in debris contamination in the plumbing lines. This fact was not known to either party when the time estimate for the plumbing work was originally provided. The additional work took an extra 2 to 3 hours to complete and the Defendant charged the Homeowners accordingly.  
 
The Homeowners initially paid the Defendant for the extra work but then sued to recover the amount paid over and above the original fixed-price contract.   
 
DECISION

The adjudicator hearing the case accepted the Homeowners’ evidence that the contract was originally meant to be a fixed-price one.  However, he also found there was “more to the story than the contractual arrangement”.  Because the Defendant did not know about the debris in the plumbing lines when the contract was made, the adjudicator found it could not be held strictly to the fixed-price contract in those circumstances.  In the result, the Defendant was entitled to some, not all, of its invoice and had to refund the Homeowners for part of the extra payment.
 
LESSONS LEARNED

Even if it initially appears that a job will be small, the possibility exists that the scope can expand due to unforeseen site conditions. Make sure your contract (especially a fixed-price contract) clearly stipulates whose responsibility it is to pay for additional costs resulting from unforeseen complications on site.  Also, if unforeseen conditions arise, ensure you obtain signed authorization from your client in advance to show that extra payments for any additional work have been agreed to.

Increases for new development could add up to $5,000 to the price of a single family home: homebuilders

The Metro Vancouver regional district, an unelected body responsible for utilities like water and sewer, are set to increase sewer fees for new development, sparking an outcry from the Greater Vancouver Homebuilders Association (GVHBA) and Urban Development Institute (UDI).

The sewer charges for new development will increase between 82% and 111%, depending on the building type, for Vancouver, and between 214% and 230% in the Fraser Valley, according to the UDI and GVHBA. “The timing of this imposed stack of government charges on new homes couldn’t be worse,” said GVHBA CEO Bob de Wit.
